Terms of Service

1. Acceptance of Terms
By accessing or using Xenith ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Eligibility and Accounts
You must provide accurate information and keep your credentials secure. You are responsible for activities under your account. We may suspend or restrict accounts for abuse, fraud, or policy violations.
3. Service Description
Xenith provides productivity, planning, reflection, and personal tracking tools. Features may change over time, including additions, removals, and experimental capabilities.
4. Acceptable Use
You agree not to misuse the Service. Prohibited activity includes:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Attempt unauthorized access, scraping, abuse, reverse engineering, or disruption of infrastructure.
- Circumvent account controls, security measures, or usage limits.
- Use Xenith to distribute malware, spam, or harmful content.
5. User Content
You retain ownership of content you create in Xenith. You grant us a limited license to host, process, and display your content solely to operate and improve the Service for you.
6. Intellectual Property
Xenith and its software, design, brand, and related materials are protected by intellectual property laws. Except for your own content and lawful use rights, no license is granted.
7. Availability and Changes
We may modify, suspend, or discontinue parts of the Service at any time. We strive for reliability but do not guarantee uninterrupted availability.
8. Subscription Plans, Billing, and Access
Xenith offers a free plan and a paid "Pro" plan. The free plan includes daily intentions, the Focus timer, reflection, routines, the 8-point Life Dimensions overview, the insights dashboard, white and brown noise, and one project. Pro unlocks every Life Dimension tool (nutrition, workout, sleep, finance, and other tracking tools), AI Coach, Growth Paths, every soundscape, unlimited projects, and priority support. We may change what is included in each plan going forward; material reductions to the free plan will be announced in the Service.
Feature gating. Pro-only screens and dashboard widgets are visually blurred with an "Unlock with Pro" prompt for free-plan users. Where a widget would otherwise show your real, empty-because-gated data, we may instead display illustrative example data purely for preview purposes — this example data is never saved, submitted, or associated with your account.
Payment processing. Paid subscriptions are billed and processed by Stripe, Inc. Xenith redirects you to a Stripe-hosted checkout page to enter your payment details; we never receive, transmit, or store your full card number, CVC, or other raw payment credentials — Stripe handles that data directly under its own terms and privacy policy. We store only what Stripe returns to identify your subscription: your Stripe customer and subscription IDs, plan, status (e.g., active, trialing, past due, canceled), and renewal date.
Billing cycle and renewal. Pro is billed monthly or annually, as selected at checkout, and renews automatically at the then-current price at the end of each billing period until canceled. We will honor any "founding" or promotional price locked in at signup for as long as your subscription remains active and uninterrupted.
Cancellation. You may cancel anytime from the Subscription tab in Settings, which opens the Stripe billing portal. Canceling stops future renewals; you keep Pro access through the end of the billing period you already paid for, after which your account reverts to the free plan and Pro-only content becomes gated again (your underlying data is preserved, not deleted).
Refunds. New Pro subscriptions include a 7-day money-back guarantee, no questions asked. Use the "Refund me" button in Settings → Subscription any time within 7 days of your first charge — it refunds that charge in full and cancels Pro immediately, and can be used once per account. If you'd rather not use the self-serve option, email [email protected] instead and we'll process it manually. Refunds outside the 7-day window, including for renewal charges, are granted at our discretion.
Local caching of access status. To avoid showing gated content while your Pro status loads, your browser caches your most recently confirmed plan status in local storage and re-validates it against our servers on each visit. This cache controls only what the interface displays optimistically; it never grants actual access to gated data or actions, which are independently verified server-side.
Your responsibilities. You are responsible for keeping your payment method current, reviewing charges, and managing your subscription through the Stripe billing portal. You are also responsible for keeping your account credentials secure — anyone with access to your account can use your active subscription, so promptly notify us at [email protected] if you suspect unauthorized access.
9. AI Features
Xenith offers optional AI-assisted features (such as insights and growth guidance) powered by third-party AI providers. When you use these features, the relevant content you submit is sent to the provider to generate a response. AI-generated output is not always accurate, complete, or appropriate for your situation, and should not be relied upon as professional, medical, financial, or legal advice. You are solely responsible for evaluating and verifying any AI output before acting on it, and Xenith and its AI providers are not liable for any decision made or action taken in reliance on it. Do not submit content you are not permitted to share.
10. Notifications
With your permission, Xenith may send push notifications and emails (such as reminders and lifecycle messages). You can manage or disable notifications in your settings or device, and unsubscribe from non-essential emails at any time. We may still send essential service or security communications.
11. Third-Party Sign-In
You may choose to sign in using third-party providers such as Google or Microsoft. Your use of those services is governed by their own terms and privacy policies, and you authorize us to receive basic account information (such as your email) to create and secure your Xenith account.
12. Disclaimer
Xenith is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. Xenith is not medical, legal, financial, or mental health advice. In particular, the Biometric Wizard and any calorie, macro-nutrient, or activity-level estimates it generates are general informational calculations only (based on standard formulas such as the Mifflin-St Jeor equation) and are not personalized medical or nutritional advice — consult a physician or registered dietitian to determine your actual caloric and nutritional needs.
13. Limitation of Liability
To the fullest extent permitted by law, Xenith is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from use of the Service.
14. Suspension and Termination
You may stop using Xenith at any time. We may suspend or terminate access if these Terms are violated or if required for security, legal, or operational reasons.
15. Changes to These Terms
We may update these Terms periodically. Continued use of Xenith after updates means you accept the revised Terms.
16. Governing Law
These Terms are governed by the laws of the United States, without regard to conflict-of-law principles.
